If the image was taken in a public place then the photographer does not need your permission to take an image.

However the photographer cannot sell the image without permission.

I did go through Susanne Carlton's profile earlier and didn't see a pic of a child in a helmet.

There's pictures of children but none with a helmet on.

"not her picher" Are you saying she did not take the photograph? That's a dangerous accusation to make without proof. If you desire to have the image removed, your best course of action would have been to speak to Susan yourself - as you obviously know her. As Bill has said already, legally Susan can display any photograph she has taken without permission - and unless she intends to sell the image, she does not need your permission.

That being said, most people would honour your wishes if you requested they remove the picture. I personally would keep it up forever if attacked in this manner, I consider it dirty underhanded tactics to run to the website moderators claiming "not her picher".

I think possibly he might be saying its her picture but of his son, and posted without his permission..
