Someone uploaded my private short film...

Hello!

I am not sure how to do this, but I privately shared a short film with an actor and found that it was listed on IMDB. I thought this was strange, as the rules state:

"Online videos must be available to the public for viewing, either free or for a fee. Videos which are set for private viewing only by selected persons are not eligible for listing."

I discovered that this actor uploaded my private film to YouTube without my consent, and I am currently trying to get in touch with him to take it down. How do I go about proving this? I never finished editing or shooting this film, and he uploaded an unfinished rough cut and claimed it as completed work.

It was never screened anywhere nor shared publicly by me.  Can I do anything about this?

Hi Luis. Your issue is with the person that uploaded it. There is nothing that IMDb can do. It only lists what contributors submit. He contributed. The database listed it.

So I assume he verified the upload by showing the version he uploaded? I a currently talking to him, can he communicate with someone and say he uploaded it against the creators will? Technically this movie does not exist. It is scenes cobbled together from something unfinished and touted by him as a movie. This is incorrect and reflects incorrectly on reality...

1) Yes, in order for a title submission to be accepted a link to an uploaded video is required.

2) Your question::  can he communicate with someone and say he uploaded it against the creators will ?

Answer is: It will not change the listing. The fact it was uploaded and contributed is a matter of public fact and knowledge. How it was done is of no concern with IMDb.

3) IMDb policy:

I tried to delete data, but it still appears on IMDb. Why?

However, IMDb will not remove accurate information. If you try to delete an item of data which is accurate, your delete will not be processed.

Thank you for the response. If the title cannot be removed from the database, I understand. But I want to stress that this is not the movie that I "Directed" or "Edited" (both of which I am listed under). He was given rough footage and cobbled it together on his own. Had I worked on this independently (as it is credited), this would not be the end result even remotely. What he submitted to you is not my movie, therefore I am falsely credited- if anything, can my name be removed from this? This is not my work.

Nor am I the writer... that credit (I assume again given by him) is also inaccurate. Can I provide IMDB with the accurate credits?

The title is in there. You have credits. You can submit an updated finished product link to the database later on.
And yes you can submit a correction for writing.

Well truth to be told, if the film wasn’t finished or never meant to be released at that ”stage” (work/rough cut etc), then IMDb should probably react. It can be a ”can of worms” situation if anyone can upload anything to Youtube, quickly create an IMDb title page and then the credits are on IMDb forever. This shouldn’t be a race about who adds the film first to IMDb, whether it’s finshed or not, or whether who’s the director or who owns the actual copyright.

The main problem now, though, is the actual Youtube video, which should be removed (probably, I’m far from expert, let alone a lawyer) based on copyright infringement. You should report the film to Youtube and explain the situation.

( But I have to stress: I don’t work for IMDb, I’m not a lawyer nor copyright expert, and all the info about this film/situation comes from this thread. This is just my opinion. )

could you please explain the difference of data on the Kindling (2018) page comparing to the Kindling on Vimeo?
And how the public release on Vimeo could happen on Feb.02, 2018, without your participation?
