Araya -- illegal listing for a Greek distributor

There is an illegal listing of a Greek distributor (New Star) for ARAYA. My company, Milestone, owns the worldwide rights and refused to work with this company. They fraudulently added it to IMDB and I have tried a number of times to delete it but IMDB won't do it.

Hi milefilms -

From your message, New Star was never a distributor for this title, is that correct?

Can you post the most recent submission reference numbers associated with your updates so our staff ca take a look?

Hi milefilms -

Thanks for posting the submission information.  In your update you noted that Milestone currently owns the worldwide rights, however, you didn't clarify whether 'New Star' was a previous distributor.  Can you clarify if this company did/didn't distribute the title in 2015 (or in any other year)?

New Star was never a legal distributor of the film. It was not a previous distributor. They have added their company to Araya on IMDB illegally. We have been the worldwide licensor of ARAYA since 2009 (before that, it had not shown or been distributed since the 1960s) and we stopped their attempt of screening the film in 2015.
I hope I've made myself understood. - Dennis

Thanks Dennis -

I have passed along the information you provided to our data editors who will investigate the distributor listing as soon as they can (fyi, likely not until next week).  As soon as I get any follow-ups or updates I will let you  know here.

Fine. Please also see this correspondence...

Dear Mr. Spanos,

To follow up on your email on April 10 regarding rights to screen Milestone's films in Greece, it has come to my attention that your company is releasing our film ARAYA on April 30th. I am attaching a copy of the poster with your logo and email address on it. These are also the links that I've found describing the release.

You also have it listed on IMDB as premiering in Greece on the 30th. Could you please advise me how you claim the rights to screen this film as we are the exclusive, worldwide rights holder to the film? I expect an answer no later than tomorrow. Thank you.

Yours truly
,

We are very interested to your films and I would like you to advise us of any of your films available for Greece only for theatrical rights.

With this opportunity I would also like to ask you to send us a list of any additional available for Greece films from your library.

Looking forward from you.

Dear Adam,

It was shown once at the Athens Avant Garde Film Festival, Athens, Greece  October 8, 2009 directly from us. The film has not been legally screened there since. I'm not sure why IMDB is more interested in keeping an illegal/non-existent credit up on your website than in protecting the legal rights of the company that restored the film and is distributing it. Can you explain this to me? I'm now in year three of trying to get this credit removed.

Hi,

I see that it was reported that Araya was going to be taken to Theaters in Greece by New Star. See for example:
http://www.culturenow.gr/37299/araya-ths-margot-benacerraf

This was posted on the 24th April a few days before the supposed release on the 30th April.

Is it possible they were showing the original version not the remastered version by Milestone Films ?

At what point did you manage to stop them showing the films (I'm going to need a little bit more context if possible).

Thanks,
Adam

NO!!! The screening was advertized and they sent out emails that they were distributing the film. We sent a cease and desist and they cancelled their screening. It never showed in Greece. Please get this straight. We own the international rights. No one could show the film -- restored or otherwise -- without our permission. They put it up on IMDB illegally without our permission. PLEASE remove this listing! I am now in year three of a very simple request. Please let me go in peace. Thank you. -- Dennis

I take it a distribution deal was made with Oscilloscope for (2011) (USA) (DVD) rights?

I've suspended the company credit and the release date for Greece 30th April 2015.

Thank you!

O'Scope is our wholesaler. They have a blanket agreement to sell our DVDs for us but we actually produce and retain the rights for each DVD.

And yes, the only time it screened was at the Athens Avant Garde Film Festival in 2009.
